PHOTOGRAPHY SERVICE AGREEMENT / फोटोग्राफी सेवा अनुबंध

This Photography Service Agreement (“Agreement”) is entered into as on date
यह फोटोग्राफी सेवा अनुबंध (“अनुबंध”) आज किया गया।

(Hereinafter referred to as “Photographer”)
(आगे “फोटोग्राफर” के रूप में संदर्भित)

(Hereinafter referred to as “Client”)
(आगे “क्लाइंट” के रूप में संदर्भित)

1. TYPE OF PHOTOSHOOT / फोटोशूट का प्रकार

This agreement is for a FREE GIFT PHOTOSHOOT, selected as:
यह अनुबंध एक निःशुल्क गिफ्ट फोटोशूट के लिए है, जिसका प्रकार निम्न में से चुना गया है:

☐ Portrait / पोर्ट्रेट
☐ Birthday / बर्थडे
☐ Baby / Kids / बेबी / किड्स

☐ Fashion / Model Portfolio / फैशन / मॉडल पोर्टफोलियो

This shoot is provided free of cost as a gift/promotional/portfolio project by the Photographer.
यह फोटोशूट फोटोग्राफर द्वारा उपहार / प्रमोशनल / पोर्टफोलियो उद्देश्य से निःशुल्क प्रदान किया गया है।

2. NO MONETARY EXCHANGE / कोई आर्थिक लेन-देन नहीं

The Client understands and agrees that:
क्लाइंट यह समझता और स्वीकार करता/करती है कि:

• No fees are charged for this photoshoot
  इस फोटोशूट के लिए कोई शुल्क नहीं लिया गया है।
• No monetary compensation, refund, or claim can be demanded
  किसी भी प्रकार की राशि, रिफंड या दावा नहीं किया जा सकता।
• The shoot is a complimentary / goodwill service
  यह फोटोशूट पूरी तरह से निःशुल्क / सद्भावना सेवा है।

3. DELIVERABLES / प्रदान की जाने वाली सामग्री

The Photographer agrees to provide:
फोटोग्राफर निम्न प्रदान करने के लिए सहमत है:

• Selected edited digital photographs (11 images, as we celebrate 11 years of experience in this field)
  चयनित एडिट की गई डिजिटल तस्वीरें (11 तस्वीरें, क्योंकि हम इस क्षेत्र में अपने 11 वर्षों का उत्सव मना रहे हैं)।।
• Final images will be delivered within 7 days or as soon as possible.
  अंतिम तस्वीरें 7 दिनों के भीतर या यथाशीघ्र संभव हो प्रदान की जाएँगी।

RAW images will NOT be provided.
RAW तस्वीरें प्रदान नहीं की जाएँगी।

4. IMAGE SELECTION & EDITING / फोटो चयन एवं एडिटिंग

• Photo selection and editing style are solely decided by the Photographer
  फोटो का चयन और एडिटिंग स्टाइल पूरी तरह फोटोग्राफर द्वारा तय किया जाएगा।
• No re-editing or additional images can be demanded
  पुनः एडिटिंग या अतिरिक्त तस्वीरों की मांग नहीं की जा सकती।
• If you have a specific theme or a reference photo you want us to follow, we will try our best to match it. You may share the image or theme preview in advance.
  यदि आपके पास कोई विशेष थीम या संदर्भ फोटो है जिसे आप अपनाना चाहते हैं, तो हम उसे पूरा करने का पूरा प्रयास करेंगे। आप थीम या संदर्भ फोटो पहले से साझा कर सकते हैं।
• Artistic judgment of the Photographer shall be final
  फोटोग्राफर का कलात्मक निर्णय अंतिम और मान्य होगा।

5. COPYRIGHT & OWNERSHIP / कॉपीराइट एवं स्वामित्व

• All photographs remain the exclusive copyright of Nisha.Click and its photographers
  सभी तस्वीरों का कॉपीराइट पूर्ण रूप से Nisha.Click के पास रहेगा।
• Client receives personal usage rights only
  क्लाइंट को केवल व्यक्तिगत उपयोग का अधिकार होगा।
• Commercial use is strictly prohibited without written permission
  लिखित अनुमति के बिना व्यावसायिक उपयोग सख्त रूप से प्रतिबंधित है।

6. PORTFOLIO & PROMOTIONAL USAGE / पोर्टफोलियो एवं प्रमोशनल उपयोग

The Client grants full permission to Nisha.Click and its Photographer(s) to:
क्लाइंट फोटोग्राफर को निम्न उपयोग की पूर्ण अनुमति देता/देती है:

• Use images for portfolio, social media, website, advertisements, promotions, contests, and exhibitions
  पोर्टफोलियो, सोशल मीडिया, वेबसाइट, विज्ञापन, प्रमोशन, प्रतियोगिता एवं प्रदर्शनियों हेतु तस्वीरों का उपयोग।
• Use images without time limitation or additional consent
  बिना किसी समय सीमा या अतिरिक्त अनुमति के तस्वीरों का उपयोग।

7. CLIENT RESPONSIBILITIES / क्लाइंट की जिम्मेदारियाँ

Mandatory Guarantor Clause for Minors / नाबालिगों के लिए अनिवार्य गारंटर शर्त

• If the Client/Model is below 18 years of age, the presence, consent, and signature of a Parent / Legal Guardian / Guarantor is mandatory.
  यदि क्लाइंट/मॉडल की आयु 18 वर्ष से कम है, तो अभिभावक / कानूनी संरक्षक / गारंटर की उपस्थिति, सहमति एवं हस्ताक्षर अनिवार्य होंगे।
• The Parent / Guardian / Guarantor confirms that they have read, understood, and accepted all terms of this Agreement on behalf of the minor.
  अभिभावक / संरक्षक / गारंटर यह पुष्टि करता/करती है कि उन्होंने नाबालिग की ओर से इस अनुबंध की सभी शर्तों को पढ़, समझ और स्वीकार किया है।
• Nisha.Click and its Photographer(s) shall not be held responsible for any dispute arising due to false age declaration or missing guardian consent.
  आयु की गलत जानकारी या अभिभावक की सहमति के अभाव में उत्पन्न किसी भी विवाद के लिए Nisha.Click एवं उसके फोटोग्राफर जिम्मेदार नहीं होंगे।

• For AI-generated Photoshoots, the client must provide the following reference images in high resolution (taken via mobile or camera):
  AI आधारित फोटोशूट के लिए, क्लाइंट को उच्च गुणवत्ता (हाई रेज़ोल्यूशन) की निम्नलिखित संदर्भ तस्वीरें प्रदान करनी होंगी (मोबाइल या कैमरे से ली गई):
  • 1 Full-body photo / 1 पूरी बॉडी की फोटो
  • 1 Headshot / Front-facing photo / 1 हेडशॉट / सामने से ली गई फोटो
  • 1 Side-profile photo / 1 साइड प्रोफाइल फोटो
• Photographer is not responsible for poor results due to:
  निम्न कारणों से खराब परिणामों के लिए फोटोग्राफर जिम्मेदार नहीं होगा:
  • Photo is not in high resolution / फोटो हाई रेज़ोल्यूशन में नहीं है
  • Photo is not provided in the required positions (front face, side face, full body, etc.) / फोटो आवश्यक पोज़िशन (सामने से चेहरा, साइड फेस, पूरी बॉडी आदि) में प्रदान नहीं की गई है

8. CANCELLATION / RESCHEDULING / रद्द या पुनर्निर्धारण

• Photographer reserves the right to reschedule or cancel due to unavoidable circumstances
  अपरिहार्य परिस्थितियों में फोटोग्राफर को फोटोशूट रद्द या पुनर्निर्धारित करने का अधिकार होगा।
• No compensation will be provided for cancellation
  रद्द होने की स्थिति में कोई मुआवज़ा नहीं दिया जाएगा।

9. LIABILITY / उत्तरदायित्व

• Photographer is not liable for injury, loss, or damage during the shoot
  फोटोशूट के दौरान किसी भी चोट, नुकसान या हानि के लिए फोटोग्राफर जिम्मेदार नहीं होगा।
• Client participates voluntarily and at their own risk
  क्लाइंट अपनी इच्छा से और अपने जोखिम पर भाग लेता/लेती है।

⭐ BONUS – INVITE FOR PHOTOGENIC FACE / बोनस – फोटोजेनिक फेस हेतु आमंत्रण

• Based on the Photographer’s selection and suitability, the Client may be personally invited for a modeling photoshoot for product photography.
  फोटोग्राफर के चयन एवं उपयुक्तता के आधार पर, क्लाइंट को प्रोडक्ट फोटोग्राफी हेतु मॉडलिंग फोटोशूट के लिए व्यक्तिगत रूप से आमंत्रित किया जा सकता है।
• Such product shoots may be for multinational e-commerce platforms including (but not limited to): Amazon, Flipkart, Snapdeal, Myntra, etc.
  ऐसे प्रोडक्ट शूट बहुराष्ट्रीय ई‑कॉमर्स प्लेटफॉर्म जैसे (पर सीमित नहीं): Amazon, Flipkart, Snapdeal, Myntra आदि के लिए हो सकते हैं।
• If our clients / suppliers for product shoots choose to hire the Client, further discussion and decision regarding the product shoot terms will be taken separately.
  यदि हमारे प्रोडक्ट शूट क्लाइंट / सप्लायर क्लाइंट को हायर करना चुनते हैं, तो प्रोडक्ट शूट से संबंधित आगे की शर्तें अलग से तय की जाएँगी।
• This bonus invitation is purely optional, not guaranteed, and subject to selection by the Photographer and/or product clients.
  यह बोनस आमंत्रण पूरी तरह वैकल्पिक, गारंटीशुदा नहीं, तथा फोटोग्राफर एवं/या प्रोडक्ट क्लाइंट के चयन पर निर्भर करेगा।

10. AGREEMENT ACCEPTANCE / अनुबंध की स्वीकृति

By signing below, the Client confirms:
नीचे हस्ताक्षर करके क्लाइंट पुष्टि करता/करती है कि:

• They have read and understood this Agreement
  उन्होंने इस अनुबंध को पढ़ लिया है और समझ लिया है।
• They agree to all terms & conditions
  वे सभी नियम एवं शर्तों से सहमत हैं।
• They voluntarily accept this Free Gift Photoshoot
  वे इस निःशुल्क गिफ्ट फोटोशूट को स्वेच्छा से स्वीकार करते हैं।
