1. Purpose of Agreement / समझौते का उद्देश्य
This agreement formalizes the understanding between the Photographer and the Model regarding participation in a complimentary photoshoot. It grants the Photographer specific rights to use the captured images for promotional and commercial purposes.
यह समझौता फ़ोटोग्राफ़र और मॉडल के बीच एक नि:शुल्क फोटोशूट में भागीदारी के संबंध में आपसी समझ को औपचारिक रूप देता है। यह फ़ोटोग्राफ़र को कैप्चर की गई छवियों को प्रचार और व्यावसायिक उद्देश्यों के लिए उपयोग करने के लिए विशिष्ट अधिकार प्रदान करता है।
2. Grant of Rights / अधिकारों का अनुदान
The Model hereby grants the Photographer and her representatives the irrevocable, perpetual, and unrestricted right to use, reproduce, and publish photographs and/or videos of the Model for:
- Marketing and promotional materials, including but not limited to websites, social media, portfolios, brochures, and advertisements.
- Licensing to third-party clients for commercial purposes, such as e-commerce platforms, brand promotions, and editorial content.
- Inclusion in stock photography collections or other commercial ventures.
The Model waives any right to inspect or approve the final images or their specific uses.
मॉडल फ़ोटोग्राफ़र और उनके प्रतिनिधियों को निम्नलिखित उद्देश्यों के लिए मॉडल की तस्वीरों और/या वीडियो का उपयोग, पुनरुत्पादन और प्रकाशन करने का अपरिवर्तनीय, स्थायी और असीमित अधिकार प्रदान करता है:
- मार्केटिंग और प्रचार सामग्री, जिसमें वेबसाइट, सोशल मीडिया, पोर्टफोलियो, ब्रोशर और विज्ञापन शामिल हैं।
- व्यावसायिक उद्देश्यों के लिए तृतीय-पक्ष ग्राहकों को लाइसेंसिंग, जैसे कि ई-कॉमर्स प्लेटफ़ॉर्म, ब्रांड प्रचार और संपादकीय सामग्री।
- स्टॉक फ़ोटोग्राफ़ी संग्रह या अन्य व्यावसायिक उपक्रमों में शामिल करना।
मॉडल अंतिम छवियों या उनके विशिष्ट उपयोगों का निरीक्षण या अनुमोदन करने के किसी भी अधिकार को त्यागता है।
3. Compensation / मुआवजा
The Model acknowledges that participation in the photoshoot is voluntary and that no monetary compensation will be provided. In exchange, the Model may receive selected edited images for personal use, as determined by the Photographer.
मॉडल स्वीकार करता है कि फोटोशूट में भागीदारी स्वैच्छिक है और कोई मौद्रिक मुआवजा प्रदान नहीं किया जाएगा। इसके बदले में, फ़ोटोग्राफ़र द्वारा निर्धारित अनुसार, मॉडल को व्यक्तिगत उपयोग के लिए चयनित संपादित छवियां प्राप्त हो सकती हैं।
4. Model’s Representations / मॉडल के प्रतिनिधित्व
The Model affirms that:
- They are at least 18 years of age.
- They possess the legal capacity to enter into this agreement.
- They will not hold the Photographer liable for any claims arising from the use of the images as outlined herein.
मॉडल पुष्टि करता है कि:
- वे कम से कम 18 वर्ष की आयु के हैं।
- उन्हें इस समझौते में प्रवेश करने की कानूनी क्षमता है।
- वे फ़ोटोग्राफ़र को इस समझौते में उल्लिखित छवियों के उपयोग से उत्पन्न किसी भी दावे के लिए उत्तरदायी नहीं ठहराएंगे।
5. Confidentiality and Conduct / गोपनीयता और आचरण
Both parties agree to maintain professionalism during the collaboration. The Model consents to the public use of their images and waives any claims related to privacy or defamation.
दोनों पक्ष सहयोग के दौरान पेशेवरता बनाए रखने के लिए सहमत हैं। मॉडल अपनी छवियों के सार्वजनिक उपयोग के लिए सहमति देता है और गोपनीयता या मानहानि से संबंधित किसी भी दावे को त्यागता है।
6. Usage Restrictions / उपयोग प्रतिबंध
The Photographer agrees not to use the images in contexts that are defamatory, pornographic, or otherwise unlawful. Any specific usage restrictions must be communicated in writing prior to the photoshoot.
फ़ोटोग्राफ़र सहमत है कि छवियों का उपयोग किसी भी मानहानिकारक, अश्लील या अन्यथा अवैध संदर्भों में नहीं किया जाएगा। कोई भी विशिष्ट उपयोग प्रतिबंध फोटोशूट से पहले लिखित रूप में संप्रेषित किया जाना चाहिए।
7. Governing Law / प्रभावी कानून
This agreement shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with this agreement shall be subject to the exclusive jurisdiction of the courts located in Indore, Madhya Pradesh, India.
यह समझौता भारत के कानूनों द्वारा शासित और उनकी व्याख्या के अनुसार होगा। इस समझौते के तहत या इसके संबंध में उत्पन्न होने वाले किसी भी विवाद को इंदौर, मध्य प्रदेश, भारत में स्थित न्यायालयों के विशेष अधिकार क्षेत्र के अधीन किया जाएगा।
8. Entire Agreement / पूर्ण समझौता
This document constitutes the entire agreement between the parties and supersedes any prior understandings or agreements, whether written or oral. Any amendments must be made in writing and signed by both parties.
यह दस्तावेज़ दोनों पक्षों के बीच पूर्ण समझौता बनाता है और किसी भी पूर्व समझ या समझौतों, चाहे वे लिखित हों या मौखिक, को प्रतिस्थापित करता है। कोई भी संशोधन लिखित रूप में किया जाना चाहिए और दोनों पक्षों द्वारा हस्ताक्षरित होना चाहिए।
